GUAY Pasatiempos Legal Notice

In compliance with Article 10 of Spanish Law 34/2002 of 11 July on information society services and electronic commerce (LSSI), we inform you that the owner of GUAY Pasatiempos is:

The activity of WEBSITESYSEO S.L. is not subject to prior administrative authorisation. The other details required by information society services and media legislation in relation to the GUAY.news newspaper are set out in the general Legal Notice.

2. Purpose of the Games section

GUAY Pasatiempos is a leisure section of the good news digital newspaper GUAY.news. It offers free games of skill and knowledge:

• word search;
• sudoku;
• Quiz Guay, with multiple-choice questions and 10 seconds per question;
• La Guay-labra, the word of the day;
• the daily challenge, the same for all players each day.

The section includes daily, weekly, monthly and annual leaderboards, per game and overall, a winners' record, badges, streaks and public player profiles. It can be used as a guest, without an account, or with a player account.

The games are purely games of skill and entertainment. They are not games of chance or betting: you do not pay to take part, no money or goods are staked, and no prizes are currently awarded. Points, badges and positions have no economic value.

This legal notice governs access to and browsing of the section. Use of the games, accounts and leaderboards is also governed by the GUAY Pasatiempos Terms and Conditions and the Participation and Prize Rules, and data processing by the GUAY Pasatiempos Privacy Policy. In anything not covered, the general GUAY.news Legal Notice and the GUAY.news general Terms of Use apply.

3. Conditions of access and use

3.1. Free and open access

Access to the Games section is open and free of charge, apart from the cost of the internet connection charged by your operator. You can play levels 1 to 5 as a guest without registering. To access higher levels, the leaderboards and the public profile you need a player account, which requires you to be at least 14 years old (or, if you are under 14, the consent of your parents or guardians) and to expressly accept the GUAY Pasatiempos Terms and Conditions.

3.2. Proper use

You undertake to use the section diligently, in accordance with the law, good faith, public order and this legal notice, and in particular not to:

• use automated means (bots, scripts, macros, solvers) to play, score or extract content;
• tamper with the website, the app, communications with the server or game data;
• carry out actions that could damage, disable, overload or impair the systems, or prevent their normal use by others;
• attempt to access restricted areas, other people's accounts or computer systems without authorisation;
• introduce viruses, malicious code or any element that could cause damage;
• extract the questions, words, grids or other content on a large scale or systematically, or use them to train artificial intelligence systems.

3.3. Technical requirements

To play you need an up-to-date browser or the latest version of the GUAY.news app, with local storage enabled. Some features, such as offline mode, are only available in the app. We do not guarantee compatibility with obsolete browsers or operating systems.

3.4. Measures against misuse

We may take proportionate measures against misuse of the section, with good reason and in accordance with the GUAY Pasatiempos Terms and Conditions and the Participation and Prize Rules, which govern the statement of reasons for our decisions and how to request their review.

4. Intellectual and industrial property

4.1. Ownership

All elements of the Games section are protected by Spanish and international intellectual and industrial property law, including the consolidated text of the Spanish Intellectual Property Law (Royal Legislative Decree 1/1996) and Spanish Law 17/2001 on Trademarks. They belong to WEBSITESYSEO S.L. or its licensors, in particular:

• the games themselves: their design, their mechanics in the specific form in which we have developed them, their levels, their scoring, badge and streak systems, and their presentation;
• the texts: instructions, hints, definitions and messages;
• the Quiz Guay questions and answers and the word lists of La Guay-labra and the word searches, as well as the collections and databases containing them, also protected by the sui generis database right;
• the sudoku and word search grids generated for the service, to the extent that they are protectable;
• the illustrations, avatars, icons, badges, sounds and other graphic and audiovisual elements;
• the source and object code of the website and the app, and their architecture;
• the distinctive signs, such as the names "GUAY.news", "GUAY Pasatiempos", "Quiz Guay" and "La Guay-labra" and their logos.

The general rules of traditional games, such as sudoku or word search, belong to no one; what we protect is our specific expression and development of those games and our content.

4.2. What you can do

You may use the games for your personal, non-commercial entertainment. You may share your results (for example, the La Guay-labra colour grid or your score) and link to the games and to your public profile. You may briefly quote a question or an expired word, citing the source, in accordance with Article 32 of the Spanish Intellectual Property Law.

4.3. What you cannot do

Without the prior written authorisation of WEBSITESYSEO S.L., you may not reproduce, distribute, publicly communicate, transform or make available to third parties the games, questions, word lists, grids, illustrations or code, create derivative products or use our distinctive signs. Nor may you decompile or reverse engineer the website or the app, except where the law permits it without the possibility of contractual exclusion.

4.4. Text and data mining reservation

We expressly reserve the use of the section's content for text and data mining, in accordance with Article 4(3) of Directive (EU) 2019/790 and Article 67 of Spanish Royal Decree-Law 24/2021, on the terms described in the general GUAY.news Legal Notice. Using it to train, fine-tune or evaluate artificial intelligence systems without our authorisation is prohibited.

4.5. Reporting infringements

If you consider that any content in the section infringes your intellectual or industrial property rights, write to us at info@websitesyseo.com stating the content, your details, the right you consider infringed and a statement of good faith. We will review it diligently and, where appropriate, remove the content.

5. Content prepared with the help of artificial intelligence

Some Quiz Guay questions, hints, words and definitions are prepared with the help of artificial intelligence, from news already published on GUAY.news, and are reviewed by the team before being added to the games. No player data is sent to AI providers to prepare them.

Human review reduces errors but does not eliminate them entirely: a question may be ambiguously worded or have an incorrect or outdated answer. The content of the games is purely for entertainment and should not be taken as verified information or as advice of any kind. If you spot an error, you can report it with the game's "Report an error" button, if available, or by writing to info@websitesyseo.com; we will review it and, where appropriate, correct or withdraw the question and recalculate the affected scores.

6. Links

Some questions or hints may link to the GUAY.news article on which they are based, which in turn links to the original source. Links to third-party sites are included for information only; those sites are governed by their own terms and policies. In accordance with Article 17 of the LSSI, we are not liable for their content unless we have actual knowledge that it is unlawful and fail to remove the link diligently. If you spot a link to unlawful or inappropriate content, let us know.

You may link to GUAY Pasatiempos, its games and public profiles from other sites, provided that you do not suggest a relationship with GUAY.news that does not exist, do not embed our pages in frames (framing) and do not present our games as your own.

7. Exclusion of warranties and liability

We take care that the games work properly, that scores are calculated correctly and that the questions are accurate, and we try to keep the section continuously available. However, as with any online service:

• we do not guarantee uninterrupted availability of the section or the complete absence of errors in the games, questions or score calculations, which we will correct when we detect them;
• guest progress and offline games are saved on your device, and we are not liable for their loss where it is due to you clearing your browser or app data, uninstalling the app or failures of your device;
• we are not liable for damage caused by third parties (for example, cyberattacks despite having adopted appropriate security measures), by failures of telecommunications networks or your connection, or by force majeure;
• we are not liable for the relationships you establish with other players or third parties as a result of the games.

These exclusions apply to the extent permitted by law. We do not exclude or limit our liability for wilful misconduct or gross negligence, for death or personal injury, or any liability that cannot be excluded towards consumers under the consolidated text of the Spanish General Law for the Protection of Consumers and Users. 8. Data protection and local storage

To play as a guest you do not need to give us any personal data. If you create an account, we process your data in accordance with the GUAY Pasatiempos Privacy Policy and, in anything not covered by it, the general GUAY.news Privacy Policy. The section does not use tracking, advertising or analytics cookies; it only stores on your device, using local storage, the information strictly necessary for it to work (such as the session and guest progress), as explained in that policy and in the GUAY.news Cookie Policy.

9. Changes to the section and to this notice

We may change the configuration, presentation and content of the section, and this legal notice, for technical, legal, editorial or security reasons. Changes affecting the games, leaderboards or accounts are governed by the GUAY Pasatiempos Terms and Conditions, which provide for good reason and the applicable notice periods. Each version of this notice has a number and an effective date, shown at the top.

10. Governing law and jurisdiction

This legal notice is governed by Spanish law, without prejudice to the mandatory consumer protection rules of the European Union country in which you habitually reside. If you are a consumer, you may bring proceedings before the courts of your place of residence. If you are not a consumer, the parties submit to the courts of Lugo (Spain). The available out-of-court dispute resolution channels are set out in the GUAY Pasatiempos Terms and Conditions.
