GUAY.news tells good-news stories that other media outlets have published first. We take the facts from them, which belong to no one, but not the way they told them: we write our own texts and headlines, we do not copy or translate, we do not use their photos and we always credit and link to the original source. If you are a media outlet and want us to correct, remove or stop using your stories, there is a fast procedure with specific deadlines. And our own content has an owner too: you can link to it, share it and quote it briefly, but not copy it or use it to train AI.
1. Purpose and owner
This policy explains how GUAY.news uses information from other media outlets, how it respects the intellectual property rights of authors, publishers and other rightholders, how media outlets and other rightholders can exercise their rights in relation to us, and on what terms you may use GUAY.news content.
GUAY.news is owned by WEBSITESYSEO S.L., tax ID (CIF) B27442433 (NIF-IVA: ESB27442433), Registered in the Companies Register of Lugo (Spain), with registered address at Calle Antonio Rosón 1, 27002 Lugo (Spain). Newspaper email: info@guay.news; company email: info@websitesyseo.com; telephone: 982 990 610. Editor-in-chief: Fredi Mosteirín.
This policy supplements the Terms and Conditions of Use and the Editorial and AI-Generated Content Disclaimer, which describes our news production process in detail.
2. The basic principle: facts are free, expression is not
Article 10 of the Spanish Consolidated Text of the Intellectual Property Law (Royal Legislative Decree 1/1996, LPI) protects original literary, artistic or scientific creations expressed by any means. What the law protects is the original form of expression (the specific wording of an article, its structure, its style, its photographs), not the facts, data, ideas or events reported. That a team of scientists has developed a new technique, that a village has restored a river or that an athlete has broken a record are facts that anyone may report.
Along the same lines, European law on press publishers’ rights makes clear that such protection does not extend to the mere facts reported in press publications.
Our entire working method is built on this principle:
- We take facts and data, not expression. An AI system extracts a list of objective facts from the original story.
- We do not copy or translate. A different AI model writes the story from scratch, in Spanish, solely on the basis of that list of facts and without seeing the original text. This avoids reproducing, translating or closely paraphrasing the source outlet’s wording. A third model checks, among other things, that there are no improper textual overlaps, and a member of the team reviews and approves each story before it is published.
- Our own headlines. Our headlines are written afresh; we do not reproduce the original outlet’s headline.
- Short verbatim quotations, only where appropriate. Where it is necessary to report specific words (for example, a statement by the person the story is about), we do so briefly, in quotation marks and attributed to the speaker and to the outlet that reported them, for information purposes and to the extent justified by that purpose, in accordance with the quotation right in Article 32(1) LPI.
- We always credit and link. Every story includes, at the foot, «Original source» with the name of the outlet and a link to its story. We want readers who wish to know more to go to the outlet that did the original work.
- We never use their photos. We do not use photographs, videos, infographics or other graphic elements from source outlets. Our images are AI-generated illustrations or freely licensed stock photos, with the appropriate attribution.
- We do not reproduce articles. We do not rely on the possibility offered by Article 33 LPI of reproducing works on current affairs, because we do not reproduce other outlets’ works: we write our own.
3. Press publishers’ rights
Article 129 bis LPI, introduced by Royal Decree-Law 24/2021, which transposes Article 15 of Directive (EU) 2019/790, grants publishers of press publications established in the EU exclusive rights of reproduction and making available to the public for the online use of their publications by information society service providers. These rights expire two years after publication, calculated from 1 January of the following year.
Those rights do not apply, among other cases:
- to acts of hyperlinking;
- to the use of individual words or very short extracts of a press publication; or
- to the mere facts reported, which, as recital 57 of the Directive makes clear, fall outside the protection.
We respect these rights as follows: we do not reproduce or make available to the public third-party press publications or substantial parts of them; we publish our own texts produced from facts; we link to the original publication; we identify the outlet by name; and, where we include a quotation, it is short and justified by its informative purpose. The full text of the original articles we consult to verify our stories is never published (see section 4).
If, notwithstanding the above, a publisher considers that any GUAY.news content affects its rights, we ask it to use the «I am a media outlet» procedure in section 6, which we will handle promptly.
4. Our crawler and access to sources
To find stories we use an automated system that operates according to these rules:
- Transparent identification: our crawler identifies itself with the user agent GUAYnewsBot/1.0 (+https://guay.news/bot). At that address we explain what it does and how to contact us.
- Compliance with robots.txt: we follow the instructions in each site’s
robots.txtfile. If an outlet does not want us to access its content, it only needs to block GUAYnewsBot in that file, in addition to being able to use the «I am a media outlet» procedure. - Compliance with text and data mining reservations: we respect rights reservations expressed by rightholders in a machine-readable manner, in accordance with Article 4(3) of Directive (EU) 2019/790 and its transposition into Spanish law (for example, through
robots.txt, metadata or reservation protocols recognised in the industry). Where text and data mining of content has been reserved, we do not process it beyond what the law permits without authorisation. - Moderate use: we make no more than one request per second per domain, so as not to overload anyone’s servers.
- Minimal access: we normally only read the headlines and summaries that outlets themselves publish in their RSS feeds, as well as GDELT and Google News RSS. The full text is downloaded only for the 40 to 60 finalist stories of each day.
- Limited retention, for verification only: the full text of those finalists is kept encrypted, used exclusively for fact extraction and internal verification that our story is accurate, never published or disclosed to third parties, and deleted after 30 days. Raw headlines are deleted after 7 days.
- No circumvention: we do not access content behind paywalls or registration walls, nor do we circumvent technological protection measures.
- We do not train models on your content: source texts are not used to train our own AI models and are not made available to third parties for that purpose.
5. Public list of sources
We maintain a public, up-to-date list of the outlets and aggregators our system consults, available on the crawler information page (https://guay.news/bot) or on request at info@guay.news. Any outlet can check whether it appears on it and request its exclusion.
Appearing on the list only means that the system may read that outlet’s public headlines. It does not imply any commercial relationship or that the outlet endorses GUAY.news, nor that GUAY.news endorses that outlet’s editorial line.
6. The «I am a media outlet» procedure
We respect the work of the outlets we draw on. That is why we offer any media outlet, agency or publisher a simple, free and fast procedure to make its wishes known regarding our stories, regardless of whether or not there is any infringement of rights.
6.1. What an outlet can request
- Removal of a specific GUAY.news story based on its reporting.
- Correction of a story of ours containing an error in relation to the original information, or not reflecting a correction the outlet subsequently made.
- Change of attribution: correcting the name of the outlet, the link or the author credited, or adding another source (for example, where the original information comes from another outlet or an agency).
- Removal of the link to its story, with or without keeping the source credit, as the outlet prefers and good journalistic practice allows.
- Complete exclusion of the outlet as a source: that we stop reading and using its reporting in future and, if it so requests, that we remove stories already published that are based on it.
6.2. How to submit a request
Please use this form:
I am a news outlet
If you represent a news outlet or a rights holder, use this form to ask us to remove, correct or re-attribute a story, remove the link, or stop using your outlet as a source. We acknowledge receipt within 2 working days and decide within 7 calendar days.
If you cannot use it, write to us at info@guay.news with «I am a media outlet» in the subject line. Please include:
- the name of the outlet and of the publishing entity;
- the name, position and contact details of the person submitting the request;
- the URL of the GUAY.news story or stories concerned (except for complete exclusion) and, where applicable, of the original story;
- what you are requesting and, if you wish, why; and
- evidence of authority to act (section 6.3).
6.3. How to evidence authority to act
To prevent anyone from impersonating an outlet, we need to verify that you are acting on its behalf. One of the following is normally sufficient:
- sending the request from an email address on the outlet’s domain (for example, newsroom@theoutlet.com) or receiving our confirmation at that address;
- the request being confirmed through the contact channel shown on the outlet’s official contact or legal notice page; or
- providing a document evidencing authority to act (power of attorney, appointment or authorisation signed by the publishing entity), in the case of law firms, rights management agencies or other representatives.
If the evidence is insufficient, we will tell you and explain what is missing, without this preventing interim removal where appropriate.
6.4. Our committed timeframes
| Step | Timeframe |
|---|---|
| Acknowledgement of receipt | Within 2 working days of receipt at the latest. |
| Interim removal | If the request is credible and concerns the removal of a story or a link, we remove the content concerned on an interim basis while we consider it, normally within the same timeframe as the acknowledgement. |
| Decision | Within 7 calendar days of receipt of the complete request at the latest. |
6.5. Effects
- Removal: the story ceases to be accessible on the website and in the app and is removed from the channels under our control to the extent technically possible. We cannot delete copies made by third parties (search engines, aggregators, users), but we will ask the main search engines to refresh their cache where possible.
- Correction: the story is corrected and, if the change is substantive, a visible correction note is added in accordance with our corrections policy.
- Change of attribution or removal of the link: the credit line of the story is amended.
- Complete exclusion: the outlet is added to an exclusion list in our system, which stops reading its feeds and proposing its stories. The exclusion remains in place indefinitely until the outlet itself asks us to reverse it.
If we decide not to grant a request in whole or in part (for example, if authority to act is not evidenced or if the correction requested does not match the facts), we will tell you and give our reasons. This procedure is voluntary on our part and in no way limits any legal action available to the outlet.
7. Claims by other rightholders and counter-notices
7.1. Claims by authors, photographers and other rightholders
If you are an author, photographer, illustrator, producer or other holder of intellectual or industrial property rights and believe that content published on GUAY.news (a story, an illustration, a stock photo, an embedded video or a user comment) infringes your rights, write to us at info@guay.news with the subject line «Rights claim», stating:
- your identity and contact details (or those of the person you represent and evidence of your authority to act);
- the protected work or subject matter and, if possible, where it was originally published;
- the exact URL of the GUAY.news content you consider infringing;
- an explanation of why you consider there to be an infringement; and
- a statement that the information is accurate and that you are acting in good faith as the rightholder or on the rightholder’s behalf.
If the claim concerns a user comment, you may also use the illegal content notice form in the Community and Comment Guidelines.
We will acknowledge receipt within 2 working days at the latest and, where the claim is credible, we will remove or disable access to the content on an interim basis while we consider it. We will inform you of our reasoned decision.
7.2. Counter-notice
If we have removed content you had posted (for example, a comment) following a rights claim, we will inform you of the reason and you may submit a counter-notice to info@guay.news within six months, explaining why you consider that the content does not infringe any rights (because it is yours, because you hold a licence, because the use is covered by a statutory exception such as quotation, etc.). Where appropriate, we will forward the counter-notice to the claimant and give a reasoned decision. If the counter-notice is well founded and the claimant does not show that legal proceedings have been brought, we may reinstate the content.
7.3. Bad-faith claims
Claims or counter-notices knowingly containing false information may give rise to liability for the person submitting them. We may stop processing claims from anyone who repeatedly submits manifestly unfounded claims.
8. GUAY.news’s own content
8.1. Ownership
The texts, headlines, selections and arrangements of stories, daily editions, newsletter, design of the website and app, source code, databases, illustrations, graphic elements, trade marks and other content of GUAY.news belong to WEBSITESYSEO S.L. or to third parties that have licensed them to it, and are protected by intellectual and industrial property law to the extent that such law protects them.
Among other rights, WEBSITESYSEO S.L. may hold the sui generis right in its databases (Article 133 LPI), by virtue of the substantial investment it makes in obtaining, verifying and presenting their contents, and the rights the law grants to publishers of press publications (Article 129 bis LPI).
8.2. What you may do
We grant you a personal, free, non-exclusive, non-transferable and revocable licence to access and read GUAY.news content for your private, non-commercial use. In addition, you may freely:
- link to any GUAY.news story, provided the link leads to our page and does not present our content as your own or display it within another page (for example, by framing);
- share stories on social networks and messaging apps using the share buttons on the site and in the app, or by copying the link;
- quote a short extract of a story for purposes of information, comment, criticism, teaching or research, in quotation marks, naming «GUAY.news» as the source and linking to the story.
8.3. What you may not do without permission
- reproduce, copy, distribute, communicate to the public or transform complete stories, substantial parts of them, editions or illustrations, in any medium or format, including other websites, apps, print publications or social networks;
- use the content for commercial purposes, including its inclusion in paid services, advertising or third-party newsletters;
- extract content by automated or systematic means (scraping, bots, spiders, bulk downloads) or re-use substantial parts of our databases;
- train, fine-tune, evaluate or feed artificial intelligence systems with our content, or include it in datasets for that purpose;
- remove or alter rights notices, source attributions, the «Produced with the help of AI» label or the metadata of our illustrations;
- present our content in a way that suggests a relationship with GUAY.news that does not exist.
8.4. Express text and data mining reservation
In accordance with Article 4(3) of Directive (EU) 2019/790 and its transposition into Spanish law, WEBSITESYSEO S.L. expressly reserves the use of all GUAY.news content for text and data mining, including for the purpose of training artificial intelligence models. This reservation is expressed here and, in machine-readable form, in the robots.txt file, in the site metadata and through any applicable reservation protocols. This reservation does not affect text and data mining for the purposes of scientific research carried out by research organisations and cultural heritage institutions under Article 3 of that Directive, nor indexing by search engines for the purpose of displaying links to our stories.
We remind providers of general-purpose AI models that Regulation (EU) 2024/1689 requires them to put in place a policy to identify and comply with such reservations.
8.5. AI-generated illustrations and texts produced with the help of AI
Our illustrations are generated with AI tools following the instructions, style criteria and selection and editing processes of the GUAY.news team, and our texts are drafted with the help of AI and reviewed, edited and approved by people.
We are cautious in describing their legal status: under Spanish and European law, intellectual property protects the original creations of human beings, and it is doubtful whether content generated by AI without sufficient creative human input is protected as a work. Accordingly:
- WEBSITESYSEO S.L. reserves all rights to which it is entitled in that content to the extent recognised by law, including those arising from human input in its conception, selection, editing, review and combination;
- in any event, the selection and arrangement of the content, the daily edition as a whole, our databases and our distinctive signs are protected; and
- regardless of their protection under intellectual property law, use of this content is subject to the GUAY.news terms of use, and systematic reproduction may constitute an act of unfair competition.
Our illustrations do not depict real people or reproduce third-party works. If you believe one does, please let us know through the procedure in section 7.
8.6. Trade marks and distinctive signs
The GUAY.news name and logo, the name «Las 7 de las 7», the slogan «El diario para gente que no quiere amargarse la vida» and the other distinctive signs used by WEBSITESYSEO S.L. may not be used without prior written permission, except to refer to GUAY.news in a descriptive and fair manner (for example, when citing us as a source). The trade marks and names of the outlets credited in our stories belong to their respective owners and are used solely to identify the source.
8.7. Third-party and user content
Stock photographs are used in accordance with their licences and with the required attribution. Embedded videos (for example, from YouTube) belong to their owners and are displayed using the platform’s embedding tools. Comments belong to their authors, who grant us a licence to display them under the Terms and Conditions of Use.
9. How to request a licence
If you wish to reproduce a GUAY.news story, illustration or edition, use our content in a media outlet, educational institution, publication or service, or syndicate our content, write to us at info@guay.news or info@websitesyseo.com stating which content you wish to use, for what purpose, in which medium, for how long and in which territory. We will consider each request and, where appropriate, propose terms. No use will be deemed authorised without an express written reply.
Please note that in GUAY.news stories the facts come from other outlets: a licence from us covers our expression and our illustrations, not the content of the original sources.
10. Infringements
Unauthorised use of GUAY.news content may give rise to the civil and criminal actions provided for in intellectual and industrial property and unfair competition law. Before taking any action, we will try to contact the person responsible to resolve the matter amicably.
11. Changes and governing law
We may update this policy to reflect changes in our process or in the law. The version in force and its date always appear at the top of the document. This policy is governed by Spanish law. For any dispute, if you are a consumer, the courts of your place of residence will have jurisdiction; in all other cases, the courts of Lugo.
